Heard Sri N.Krishna Sumanth, learned counsel for the petitioners and Sri K.Tharun Chowdary, learned Assistant Government Pleader representing learned Advocate General appearing for the respondent Nos. 1 to 5. With their consent, this writ petition is disposed of at the stage of admission.

Learned counsel for the petitioner submits that the present Writ Petition is filed seeking to declare the inaction of respondent Nos.2 to 5 in de-registering the mortgage deed bearing document No.865 of 2OOI dated 2l.O3.2OOl and mutate the name of petitioner No.2 as the legal heir of Late B.V.V.Satyanarayana with respect to property bearing MCH No.17-l-3761478 admeasuring 9O.O2 sq.yds (equivalent to 75.25 sq. mtrs), situated in Ward No. 17, Block No.1, Santosh Nagar, Hyderabad, pursuant to the representation dated 02.12.2024 issued by the petitioner No.1, as illegal, arbitrary and consequently to direct the respondent Nos.2 to s to forthwith de-register the mortgage deed bearing Document

No.B65 of 2o01 dated 2l.o3.2ool and mutate the name of petitioner No.2 as the legal heir of Late B.v.v.salyanarayana.

Learncd Assistant Government pleader, or1 written instructions issued by the respondent No.S, submits that there is no provision to de-mortgage a property on presentation of a mere representation to .the Registering officer under the provisions of the Registration Act, 190g (for brevity, "the Act, 1908') and the scheduled property can be reconvened only through presentation of a Reconveyance Deed. But the petitioner has not presented any Reconveyance Deed so far and if it is presented, the document will be processed under the provisions of the Act, t 1908 and [ndian Stamp Act, 1899.

4 Learned counsel for the petitioners did not dispute with the submission made by learned Assistant Government Pleader and seeks liberty to submit the Reconveyance Deed to the registering authority and requested to pass appropriate orders

[n view of the above made submissions, this writ Petition is disposed of granting liberty to the petitioners to submit the Reconveyance Deed of the suit schedule property to the respondent authorities and on such submission, the respondent authoritie's are directed to pass appropriate orders strictly in accordance with law, as expeditiously as possible.

Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
