' ]'his Criminal Petition is filed under Section 482 of the Bharati,ya Nag:Lrik Suraksha Sanhita, 2023, for granting of pre arrest bail to the petitioner/ accused No.1 in Crime No.l0 of 2025 ort the lile of the Wanapartl.ry Rural Police Station, Wanaparth.y, registered for the alleged offences punishable under Sections :3 16(5) ancl 318(3) of the BNS.

Ileard Sri I(. Rathanga Pani Reddy, learned counsel for the petitioner and Sri Syed Yasan Mamoon, Iearned Additional Public Proseculor, appearing for respondent.

As seen from the record, since the petitioner is not agreement holder, Section 316(5) of the BNS is not applicable to the petitioner. Hence, this Court deems it appropriate to direct petr'tioner/ accuscd No. 1 to appear before the Investigating Officer on or before 06.02.2025 between l1:O0 a,m. and O5:00 p.m. arrd in turn, the Investigating Officer is directed to follow the procedu re laicl down under Section 35 (3) of the BNSS (previously, Section 41-A of Criminal Procedure Code) and atso the guidelines formulated by the Hon'ble Supreme Court of India
