ORDER:

Seeking the Court to enlarge the petitioners who are arrayed as accused Nos.2 and 5 in Crime No.16 of 2025 of Bejjur Police Station, Komurambheem Asifabad District, on bail, the present Criminal Petition is filed.

The brief facts of the case are that on 29.01.2025, de facto complainant lodged a complaint at Bejjur Police Station stating that her husband, Chinnanna, died on 16.01.2025, and was buried in their cotton field. However, on 29.01.2025 her sons discovered that the dead body had been removed, and both hands were cut off and found in the pit. He suspected some unknown persons who had been visiting a neighbor's house and, along with villagers, confronted them, but they threatened and chased her away. She requests action against them as per law.

Learned counsel for the petitioner submitted that the petitioners are innocent and were wrongly arrested and remanded to judicial custody without evidence. He further submitted that the Police failed to arrest the real culprits and instead implicated the petitioners based on an extra-judicial confession and that the allegations against the petitioners do not constitute any offence and that they are entitled to regular bail. The Petitioners have been in judicial custody since 29.01.2025, and the material part of the investigation is completed. Therefore, he prayed the Court to grant bail to the petitioners by allowing this Criminal Petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners stating that the investigation is not yet completed, therefore, granting bail to the petitioners, at this stage, does not arise. Hence, he prayed the Court to dismiss the criminal petition.

After considering submissions from both the parties and reviewing the record, it appears that the petitioner is

languishing in jail from 29.01.2025. As seen from the record, ten witnesses were examined and the material part of investigation is completed. Considering the facts and circumstances of the case, this Court deems it fit to grant bail to the petitioners subject to the following conditions:

ii. The petitioners shall appear before the concerned SHO at 11:00 a.m., on every Sunday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii. The petitioners shall abide by the conditions stipulated in Section 437(3)

Accordingly, the Criminal petition is allowed.
