ORDER:

The present Criminal Petition is filed praying this Court to grant pre arrest bail to the petitioner who is arrayed as accused No.1 in FIR.No.877 of 2025 before the uPPAL Police Station, Rachakonda, registered for the offences punishable under Sections 121(2), 132, 191(2) read with 190 of BNS.

The brief facts of the case are that on July 20, 2025, during the Bonalu Festival, a police team led by the complainant (2^nd respondent) was performing bandobast duties for the Palaram Bang procession at Bharat Nagar, Ramanthapur. They stopped a car driven recklessly towards the procession, and the occupants fled. A drunken individual claimed ownership of the car and was taken to the police station along with the vehicle. Later, a group of 8-9 people, allegedly associates of the car's owner, gathered and assaulted the complainant and his staff, including HC-4319 K. Suresh and PC-5939 Lakhan, who sustained injuries.

Heard Sri G.Parashuram, learned counsel for petitioner, and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for respondent – State.

Learned counsel for petitioner submitted that the petitioner is innocent and has been falsely implicated in the case. He further submitted that the complaint is allegedly a result of rivalries trying to falsely implicate the petitioner. He contended that the allegations are false, vague, and lack evidence, and the petitioner's role in the case seems inconsistent, being arrayed as Accused No. 1 in the Remand Case Diary and Accused No. 3 in the FIR. While advocating that the petitioner is law-abiding citizen and needs to take care of old-age parents, he prayed this Court to grant anticipatory bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for petitioner stating that the allegations against the petitioner are of serious nature which requires investigation. He further submitted that there are three other cases pending against the

petitioner. Therefore, prayed the Court to dismiss the criminal petition.

Having regard to rival submissions made and on going through the material placed on record, it is noted that though learned Additional Public Prosecutor submitted that there are three other cases pending against the petitioner, the instructions furnished before this Court would reveal that there are no previous cases against the petitioner. Therefore, considering the facts and circumstances of this case in detail, this Court deems it fit to grant pre-arrest bail to petitioner, subject to compliance of the following conditions:

i. The petitioner shall surrender before the Station House Officer, Uppal Police Station, within two weeks from today, and on such surrender, the said Station House Officer shall release petitioner on bail, on his executing a personal bond for Rs.25,000/(Rupees Twenty Five Thousand only), with two sureties, for the like sum each.

ii. The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita,

2023 and co-operate with the Investigating Officer in investigating the case.

iii. The petitioner shall appear before the concerned Investigating Officer on every Wednesday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending, shall stand
