These Writ Petitions are filed^{by the petitionersseekingto} declare the action of the^{respondent-authoritiesin attemptingto take} away the subject dwelling^{lands and houses of the petitioners in} Maya Bazar Village,^{Dhanbad Panchayat,without initiating and} following acquisition^{proceedings as provided in the Right to Fair} Compensation and^{Transparency in Land Acquisition, Rehabilitation} and Resettlement Act,^{2013 ('the Act, 2013'), or as amended State} Act 21 of 2017 and,^{proceedingto displacethe petitioners from their} respective houses, without^{providinglawfulcompensationand} Rehabilitation and Resettlement^{as required underthe Act and ruies} therein as illegal, unconstitutional^{and consequentlydirectthe} respondent authorities to strictly^{comply with all the procedures} provided under the Act, 2O13^{for acquisition of the subjecthouses of} the petitioners in Maya^{Bazar Viilage, Dhanbad Panchayat,} Chunchupally Mandal, Bhadradri^{Kothagudem Districtfor the} purpose of coal mining in^{Venkatesh Khani taken up by 07n} respondent company and extend^{compensationand Rehabilitation} and Resettlement entitlements^{as providedunderthe Act'}

The petitioners claim to be residents of Maya Bazar, Rudrampur Village, Chunchupally Mandal, Bhadradri Kothagudem District and they belong to below poverty line and Scheduled Castes and Scheduled Tribes community. It is their case that they have constructed small houses in an extent ranging from 50 to 1OO Square yards and they are residing in the aforesaid Village and also paying property tax. It is further case of the petitioners that small portion of houses/huts/sheds were acquired by respondent No.7 for the purpose of Mining activity. The grievance of the petitioners is that while dispossessing them from their respective premises, the respondents have not foilowed any procedure contemplated under the Act, much less not paid any compensation.

Learned Government pleader for Revenue appearing for respondent Nos.1 to 6 vehemently submitted that Government after conducting enquiry has allotted.house sites to an extent of 100 square yards to the eligible persons and since the petitioners have not produced any documents to the satisfaction of the respondent authorities, they have not been allotted house sites.

Sri P.Sri Harsha Reddy, learned Standing Counsel for Singareni Collieries Company Limited, submitted that as per the list furnished by the Government, house sites were allotted to the eligible p"."orr} Tt is further submitted that since it was revealed that t

petitioners are^{not eligible for grantof house sites, the caseof the} petitioners lvas not considered.

Since the specilic^{case of the petitioners is that theyare} residents of Maya^{Bazar, Rudrampur Village, ChunchupallyMandal,} Bhadradri Kothagudem^{District, and are eligible for the allotment of} house sites and^{other benefits under the provisionsof the Right to} Fair Compensation and^{Transparency inLandAcquisition,} Rehabilitation and^{Resettlement Act, 20 13, but their case has not} been considered,^{this Court is of the view that ends of justicewould} be met if the^{petitioners are directedto approach respondentNo.3} and submit a representation^{along with relevantdocuments, suchas} property tax receipts, electricity^{bills, etc., to satisfy the requirements} for the grant of house^{sites. Upon submission of such representation,} respondent No.3 shall^{considerthe petitioners'case for allotment of} house sites and^{other benefitsas provided under the provisions of} the Act, 2013. If the^{petitioners fail to producethe requisite} documents to the^{satisfactionof the respondent authorities, a socio-} economic survey^{shall be conducted to determinetheir eligibility for} the allotment of^{house sites under any schemeintroducedby the} Government.
