Petition under Articre 226 0f the constitution of rndia praying that in the circumstances stated in the affidavit fired therewith, the High court may be pleased to issue an order, direction or writ more particurarry one in the nature of writ of Mandamus or any other appropriate writ, decraring the action of the respondents 1 to 5 in not granting the second increment to the petitioners as contemprated as per the procedure raid down under crause 2.g.4 0f NC wA-vr Read with clause 2 (b) of Memorandum of understanding dt.13_09_2000 and 13_ 12-2000 as illegal, arbitrary, discriminatory and violation of Articles 14, 16 of the constitution of rndia and consequentry direct the respondent nos. 1 to 5 to rerease the second increment to the petitioners as contemprated as per the procedure raid down under crause 2.9-4 of NCWA-vr Read with crause 2 (b) of Memorandum of Understanding dt.13-09-2000 and 13-12-2000 0n par with other emproyees similarly situated like them with interest and consequential benefits.

Aggrieved by the inaction of the respondents in granting the second increment to the petitioners as per the procedure laid down under Clause 2.9.4 of National Coal Wage Agreement-Vl d,ated, 23.72.2OOO r/w. Clause 2(b) of the Memorandum of Understanding dated 13.09.2000 \ \ alrd l3.l2.2OOO, the present Writ Petition is filed.

When the matter is taken up for hearing, Sri K. Thirumala Rao, learned counsel appearing for the petitioners submits that the lis in the present Writ Petition is squarely by the adjudication of this Court in W.P.No.25912 of 2O2l vide order dated 21.O3.2023, and prays this Court to pass a similar order in the present Writ Petition also.

The above made submission is not seriously disputed by the learned Standing Counsel appearing for the respondents.

In view of the above and for the reasons a-like in the order dated 21.O3.2O23 passed in W.P.No.25912 of 2021, the Writ Petition is disposed of directing the respondents to release the second increment to the petitioners as per the procedure laid down under Clause 2.9.4 of the National Coal^.Wage Agreement-Vl dated 23.12.2000, read witJ, Clause 2(b)
