Criminal Petition Nos.1939 of 2024 and 1945 of 2024 are filed by the petitioners-accused Nos.1 and 2 respectively under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short, ‘Cr.P.C.’) for grant of regular bail in Crime No.3 of 2024 on the file of the Excise Police Station, Hayathnagar, Ranga Reddy District, registered for the offence under Section 8(c) read with 20(b)(ii)(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘NDPS Act’).

The case of the prosecution in brief was that on 11.01.2024 at 6:30 A.M., the Prohibition & Excise Sub Inspector, Hayathnagar along with his staff conducted route watch and found the petitioners proceeding on foot carrying college bags. On suspicion, he checked their bags and found three brown colour polythene covers weighing 2.335 Kgs., 2.285 Kgs. and 2.355 Kgs. of dry ganja, total 6.975 Kgs. of dry ganja and seized the same in the presence of panch witnesses and lodged the report. Basing on the said report, the above crime was registered for the above offence.

Heard the learned counsel for the petitioners and the

learned Additional Public Prosecutor for the respondent-State.

Learned counsel for the petitioners submitted that only an

intermediate quantity of dry ganja was seized from the possession of the petitioners and no criminal antecedents were reported against them and prayed for grant of bail to the petitioners.

Learned Additional Public Prosecutor also reported that

there were no criminal antecedents against the petitioners.

Perused the record. Considering that the contraband

seized was only in intermediate quantity and no criminal antecedents were reported against the petitioners and as the petitioners were in judicial custody since 11.01.2024, it is considered fit to enlarge the petitioners on bail on certain conditions.

6. Accordingly, these Criminal Petitions are allowed and the

petitioners/Accused Nos.1 and 2 shall be released on regular bail subject to the following conditions:

i) The petitioners/Accused Nos.1 and 2 shall execute a personal bond for a sum of Rs.25,000/-

(Rupees Twenty Five thousand only) each with two sureties for a like sum each to the satisfaction of the learned XIII Additional Metropolitan Sessions Judge, Cyberabad, Ranga Reddy District at L.B. Nagar.

ii) The petitioners/Accused Nos.1 and 2 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.
