The petitioner, after coming to know that the subject property was attached by the l"t respondent uide G.O.RI.No.9O6, dated 25.08.2020, has Iiled an application viz., Criminal M.P.No.93 of 2O2l in Criminal M.P.No.2OS of 2O2l in Crime No. 17 of 2O2O before the Metropolitan Sessions Judge, Hyderabad seeking to set aside the order of attachment passed by the lst respondent uide G.O.Rt.No.9O6, dated 25.O8.2O2O. However, uide order dated O5.01.2022, the Court below dismissed said Criminal M.P.No.93 of 2O2l in Crime No.l7 /2O2O holding that the accused (6tr respondent herein) had started chit business in the year 20 17 and the accused cheated the innocent subscribers and lured their properties and sold them away, and one such property was sold to the petitioner herein in tJre year 2018 under a valid registered Sale Deed bearing Document No. 12953 of 2018, dated 28.11.2018. Thereafter, the accused also filed Insolvency Petition to avoid attachment of properties belonging to the accused (6tt' respondent herein).
