3.LearnedcounselforthepetitionerSUbmitSthatpursuantto the directions^{issued by this Court in W'P'Nos'26310of 202t and}

2999 of 2022,^{dated 18.08.2022, respondentNo'2 had conducted} public auction on 31.10.2022^{in respectof the immovable propefty} bearing Flat^{No.204,2nd floor, Gokul ApartmentbearingMunicipal} No.1-10-1U1,^{situatedat Ashok Nagar, Hyderabad' wherein the} petitioner had stood as^{highestbidder by biddingfor a sum of}

Rs.49,69,0(10/-.^{On the sameday, i.e., 31.L0.2022,the petitioner} paid Rs.7,45,3541- and on 74.71.2022, the^{petitioner paid the} remaining balance^amount of^{Rs.42,23,650/-under due} acknowledg3ment.^{Evenafter paying the entire bid amount within} the time l)rescribed, respondent^{No.2 had not issuedsale} certificate^l:o the^{petitioner.Hence, the petitionermade a} representation dated^{19.72.2022 to respondent No.2 requesting to} execute an(l register the^{sale certificate.Respondent No.2 vide} letter No.R(.No.2582/20t8lMACS, dated^{18.01.2023 declining to} issue sale^certificate on^{the ground that as per the directionsof} this Court^passed in^{W.P.No.26310of 2O2l and W.P.No.29999of} 2022, the s.:le confirmation^would be^{subject to the result} of^the partition sui: O.S.No.220 of 2OL8 on the file of III Additional Chief Judge, City Civil Court,^{Hyderabad.Learnedcounsel further} submits that the auction^{processwould conclude only with the} issuance ol sale certificate,^{however, respondent No.2 by} misconstruir^g the orders of^{this Courtrefusing} to^{issue sale} certificate, despite of^{remitting the} entire^bid amount.^{Hence, the} present writ petition.

Respondent No.3 filed counter stating that even after depositing tlre entire bid amount by the petitioner, as the public

auction^process is^{not completed,the respondent-societyis unable} to utilise the bid amount deposited,^{thereby the respondent-} society is deprived of the^{fruits of the decree.Therefore, the} respondent No.3 made a^{representation to respondentNo'2 on} 09.01.2023 seeking issuance of^{sale certificate in favour of the} petitioner, however, till date for the best^{reasons known to} respondent No.2, he^failed to^{issue and registerthe sale certificate} in the name of the^{petitionerleaving respondentNo.3 in distress,} as they are unable to utilise^{the sale proceedsin view of non-} finalisation of the^public auction.

In view of the^{aforesaid submissions, respondentNo'2is} directed to examine the^{representation, datedL9} 'L2'2022 submitted by the^{petitioner and pass appropriate ordersstrictlyin} accordance with law,^{as expeditiouslyas possible,preferably within} a period of four(4)^{weeks from the date of receipt of a copy of this} order and communicate^{the same to the petitioner.There shall be} no order as to costs.
