Petition under Article 226 of the Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, Order or direction more in the nature of Mandamus declaring the action of the respondent, particularly, the District Fisheries Officer, IVlahabubabad, in not registering the Fishermen Cooperative Societies based on petitioners applications dt.27.3.2021 ,8.4.2021 ,8.4.2021 , and 8.4.2021, inspite of the orders issued by the Government in Memo No. 25891, andF 1A212017 d1.29.5.2019, Circular Memo d1.1.9.2021, Memo of the Commissioner dt.3.7.2021, Memo of the Commissioner dt.27.'12 .2021 and inspite of amendment carried out to G.O.NIs.No.17 A.H.D.D. & F Dept dt.7.9.2021 vide G O.Ms.No.6 A.H.D.D &F Deptdtt.22.7.2022 as illegal, arbitrary and violates Article 19 and 21 of the Constitution of lndia and contrary to Section 2(g) and 3 of the A.P.GS) S.A. L T.R. 1/59 and its Amendmenl 1170 and contrary to the law laid down by the Supreme Court of lndia in Samatha Vs. State of A.P. and Ors reported in 1 997 (8) SCC 1 91) and consequentially direct the respondents particularly, the District Fisheries Officer, Mahabubabad, for registration of Fishermen Cooperative Societies, Guduru, for 4 Gram Panchayats ie, Guduru, Gram Panchayat, Marrimitta, Brahmanapalli, Ayodhyapuram, for granting fishing rights on lease basis.
