Petition Under Article 226 of lhe Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ or order or direction especially one in the nature of mandamus; i) declare the Memo No.CGM (HRD)/GM(S/AS-Ill/J1lF.No.4B8D/02-9 dt.19.1.2005 and the Memo No.CGH (HRD/GM (S)/AS-|ll/J1lF.No.438Dl02 5r.D1.27.11.2003 of the first respondent including the Memo No.CGM (HRD/GM/AS/(DC)iF.No. 438-D102-7, dt.23.9.203 of the second respondent as illegal, arbitrary and unsustainable in law and set a side the same; ii) direct the respondents to sanction the increments to the petitioner without reference to the punishment of stoppage of an increment imposed on him and grant pension and pensionary benefits on basis said pay fixation and grant all consequential benefits.

Today, the learned counsel for the petitioner has stated
