This Writ Petition is filed seeking a Writ of Mandamus to declare proceedings No.B I 1436 I 2O06, dated O2.O3 .2OO7 ,^passed by respondent No.5 insofar as resumption of lands admeasuring Acs.5.OO gts., and Acs.5.00 gts., respectively in Sy.No. 148 of Kallakal Village, Toopran Mandal, Medak District, belonging^to petitioner Nos.I and 2, as illegal and arbitrary.

When the matter is taken up for consideration, it^{is brought} to the notice of this Court by the learned counsel^{for the petitioners} that under similar circumstances, the very sa-.^impug.,edE' proceedings were set aside by a learned Single Judge of^{this Court} in Writ Petition No.27604 of 2OO7, dated 06.^{11.2O14 and a copy of} the said order is also placed before Court.

lrarned Assistant Government Pleader for Assignment after having perused the said order fairly conceded that the issue involved in this Writ Petition is squarely covered by the said order in Writ Petition No.276O4 of 2OO7 .

In the light of the abovc and for the reasons alike as assigrred in the order, dated O6.1 I.2Ot4 in Writ petition No.276O4 of 2OOZ, the impugned proceedings, dated O2.O3.2OOT, issued by respondent No.S in this Writ petition is also set aside, insofar as

the lands bcing claimed by petitioner Nos. 1 and 2 admeasuring Acs.S.o0 gts., each. If there exists a t-anse cf action either under the Anchra Pracresh Assigned Lands (prohibitior of rransfers) Act, 7977 , or the respondents intend to resu,le the said land s rbr public purpose, it is open to the respondents to put the petitioners on notice, call for their explanatr'on, conduct an enquiry atrd thereafter, pass appropriate orders, in accor.darce with law. 5' Accordingly, the writ petition is allorved as indicated hereinabove.

As a sequel, miscellaneous petitions, pending if any in this Writ Petition, shall stand closed. No costs.
