t. The revision petitioner is aggrieved by dismissal order of protest petition Iiled questioning the linal report filed by the police closing the case in Crime No.1510 of 2014 Order was passed by 1.he III Additional Chief Metropolitan IMagistrate a1 l.lr,dcrabad.

A private complaint u,as lilr:d by GPA holder of these petitioners alleging that the Iand in Sl-raikpet village was purchasecl by the uncle of the complainant in Lhe year 1965. After commencement of Urban Land Ceiling Act in the year 197 5 . 31499 sq.yds was occupied by the Government. Thev approachcd tlre Special Ofhcer, Land Ceiling Authority in the year 1983 and after veril-1,ing the records, 5000 sq.meters of the occupied land was releasr:d. Tlrc rcmaining land rvas claimed by the accused by showing it as rn Circle No.10, though it was present in Circle 7. It is further the case that the respondents/ accused submitted proposal to lhe Gor,ernment for regularization of their possession by producing property tax receipts and electricity receipts showing that their land is situated in Circlc No.10 and obtained orders illegally. 1'herea ftcr, the partres havc :rlso i-rpproached by fiJing writ petitions beforc this Court. Thrr complaint ,,\ as registered by police.

3 During the course of investigation, it was found that the accused Nos'6 to 42 who are the beneficiaries have not fabricated a,.,y documents. Further, it was arso found that only because the government ofliciars arrayed as A 1 to A5, issued information that the land falls in circle NO 10' that in itself would not be sufficient to believe the contention of complainant that the accused/benefrciaries had submitted fabricated documents claiming right over the said land. since the writ petitions were also fired and pending before this court, pararel ritigation by filing the present crimina-l compraint cannot be permitted. on the said basis, the investigation was closed. The protest petition filed by the petitioner/compiainant before the III Additionar chief Metroporitan Magistrate at Hyderabad, questioning the final report was dismissed. Present revision is frled aggrieved by the order passed in the protest petition.

4' The grounds raised by the revision petitioner are that the court bel0w fa,ed to determine that the subject land fa1ls in circle No.7 a,-,d not in Circle No.1O as claimed by the accused. The Court has not followed the procedure prescribed under code of criminal procedure a,d dismissed the complaint at the stage of taking cognizance.

The reasons given l>y thc learnecl Magistrate are that no documents are produced to ascertain firstry r hat any fabricated documents were produced by the clrrimants/ be,e ricraries/ accused and that the land in fact falls in Circle No.7 and not in Circle No. l0 as claimed.

6' This court under revisional powers can interfere onry if the orders are unreasonable, improper ancl r-rot based on record. on the basis of the evidence produr:ed, learnc:cl \4agistrate had rightly concluded that there is no prima facie evrdence t() [ake cognizance of any of the offences under Sections 447, 42O, 423. 46g, 4TI r/w l2O_B of IpC. The complainant merell' assertecl that Lrocuments were fabricated but there is no proof. whether the land fal s i^ circle I 0 or circre 7 is to be determined in the civil or rvrit proceedings.
