The brief^{facts of the case are that a complaint has been} preferred^{bY resPondentNo.l against the petitionersfor the} Section 23(1)^{of Andhra Pradesh} offences^{registeredunder} Live Stocks)^{Market Act, 1966 (for} (AgrigPltfrral^{Produce and}

short, "the Act, 1966"1 and for recovery of market fee of Rs.84,161/- from 2OO2-2OO3 as per the provisions of the Act, 1966 payable to respondent No.1.

It is submitted that in the year, 2002-2003 for the first time, the Government declared Rice as an agricultural produce for the purpose of levy of market fee. The sarne was challenged by the Rice millers of the state before the erstwhile High Court of Andhra Pradesh. While disposing the batch of Writ petitions, the erstuhile High Court of Andhra pradesh declared Rice as an agricultural produce.

It is submitted that the Rice millers made several representations to the Government for waiver of levy of market fee for the period of litigation i.e., from 2OO2 to 2003 and subsequent periods. Thereupon, the Government vide Memorandum No.4o32lMktg-Il-l/2OO5, dated 07.Ot.2006 specifically mentioned not to initiate steps for recovery of the market fee levied for the period of litigation. Further, respondent No.1 vide notice dated 2l.0l.2006 clearly stated that their ofhce will not insist for recovery of arrears of market fee on Rice pertaining to the period of litigation in the High court and insisted for payment of market fee on sale from 22.12.2004 onwards. the same, the present complaint has been filed against^the petitioners. Therefore, the present Criminal^Petition is Iiled^{by the} petitioners seeking to quash the impugned^proceedings.

The petitioners submitted that out of^{sixteen(16) Rice mills} in the present S.T.C.s, thirteen^{(13) Rice mills were closed for} various reasons. Some of the Rice^{millersexpired and three(3)} Rice mills were functioning.^{The petitioners have been paying the} market fee regularly from time to time^{and there was no dispute} at any point of time except for the litigation^{period2OO2to 2003.} The petitioners contended that the^{presentcomplaint has been} filed without any cause of action and^{the same liable to be} dismissed.

B. Learned counsel for the petitioners^{submittedthat the} matter is pending from the^{year, 2Ol4 and his best efforts to} come in contact with the petitioners^{have gone in vain. Therefore,} seeks to close the Criminal Petition^{granting liberty to the} petitioners to work out the remedies^{availableunder law'}
