Heard Mr.Pasham Krishna Reddy, learned Government Pleader for Municipal Administration ald Urban Development representing respondent No. 1; Mr.Maruthi Jadhav, learned Assistant Government Pleader attached to the Office of the learned Advocate General representing respondent No.2; Mr.P.Ravi Shankar, learned counsel for respondent Nos.5 to 16; Mr.S.Balchand, learned counsel for respondent No.89; and Mr.Raja Gopalavan Tayi, learned counsel representing respondent Nos.90 to 117, ll9 to 722; 124 to 135.

Subject matter of the writ petition and the related contempt case is alleged encroachment in Siddiamber Bazar and Mahaboobgunj areas and inaction of Greater Hyderabad Municipal Corporation (GHMC) in removing such encroachments

Irlitially, the rvrit petition was filed by a petitioner - in person. Subsequently, in the proceedings held on O5.O9.2022, he u,'as removed as petitioner - in - person, vgherc after it^q.as taken up as a suo tnotu writ petition.

4 . On 28.O9 .2022, \/e had directed personal appearance of the Commissioner of GHMC on 04.1I.2022 and thereafter, this Court passed the following order on 04.t1.2022:

"Mr. D.S.Lokesh Kumar has also filed an affidauit detailing the steps taken to remoue encroachments ouer Siddiamber Bazar area.

In paragraph 1 1, it is stated that GHMC has ftxed encroachment remoual program for unauthorized encroachments at Siddamber Ba-z,ar and Mahaboobgunj front 2O.1O.2022 to 19.1 1.2022.

Duing the hearing todag, Commissioner has also informed us that in addition to imposition of penaltg, steps haue been taken for prosecution of the encroachers under the law.

He has also submttted that prouisions for CCTV cameras and putting up of public notices in the fornt of hoard tgs taarning the encroachers of the steps that mag be taken

against them utould be put up in conspicuous places in the localitg.

Let GHMC carry out the aboue exercise in accordance uith latu so that encroachments are remoued from ouer the roads and pauements to enable the citizens and pedestians to haue free access through the roads and pauemeftts.

Outcome of the aboue steps shall be informed to the Court bg utay of a report on the next date.

Presence of Mr. D.S.Lokesh Kumar, Commissioner of GHMC is dispensed with for the time betng.

In terms of the aforesaid order, a report \IA S submitted by the Commissioner on 08.12.2022 which was considered in the proceedings held on 09 .12.2022 . Relevant portion of the order dated O9.12.2022 reads as under:

GHMC and its officials haue imposed penalty on uaious shop oturters uho had encroached the roads and pauetnetis by placing mateials on road margins etc., in Siddiatnber Bazar and Mahaboobgunj. A statement has been fumished shouing the shop owners on uthom penalties were leuied for encroachment. That apart, Station House Officer, Afzalgunj Police Station had also been requested by letter dated 18.11.2022 to register cases against aboue shop ou)ners-

While we appreciate tLLe steps taken bg the GHMC in remouing encroachments from Mahaboobgunj and Siddiamber Bazar areas, u)e are houteuer of the uieu.-t that such diue should. continue on a regular basis. Therefore, we intend to monitor the same for some more time. On the nert dab, Commissioner of GHMC shall file updated report regarding the steps taken or deuelopments post report dated 08. 1 2.2022.

Today when the matter is called upon Mr.Maruthi Jadhav, learned Assistant Government Pleader attached to the Office of learned Advocate General has placed before us a copy of report filed on behalf of respondent No.2 i.e., GHMC. It is stated that GHMC is continuously conduttffig

road encroachmer-rt removal program and has placed sign boards on the footpaths prone to encroachment in Siddiamber Bazar and Mahaboobgunj areas. As per record, police has registered 33 cases against the encroachers. Police personnel have kept constant vigil against any illegal encroachments. GHMC, u'ith the help o[ police personnel are on a continuous drive to remove encroachments.

7 . While \.e accept the report submitted by respondent No.2, we are of the view that such drive should be continued by respondent No.2 from time to time and ensure that there is no fresh encroachment in Siddiamber Bazar and Mahaboobgunj areas of Hyderabad.

B. In the light of the above, we are of the further view that the purpose for which the writ petition was filed has been achieved.

¶219

Consequently, we are of the view that the writ petition and the related contempt case are now required to be closed. Both are accordingly ciosed.
