issued by respondent No.4-Revenue Divisional Officer under Section 245 of the Andhra Pradesh Panchayat Raj Act, 1994 (for short 'the Act'), stating that a notice of intention to make a motion expressing want of confidence in the Upa-Sarpanch of Gram Panchayat has been delivered to him under Se clion 245(2) of the Act and further stating that a meeting is scheduled on 07 -02-2022 at 1l-00 AM at the office of Gram Panchayat, Gundi, for consideration of the alleged motion of No Confidence. He submits that the said notice was served on the petitioner on 24-01-2022. Learned counsel submits that Section 30 of the Act deals with motion of No Confidence of Upa-Sarpanch and as per G.O.Ms.No.200 dated 28-04-'1998, rules are prescribed for the No Confidence motion. Learned counsel for the petitioner submits that as per said G.O., Rule 3 prescribes that the concerned officer shall convene and preside over a meeting for the consideration of the motion at the Office of a Gram Panchayat or at the Mandal parishad or at the Zilla Parishad, as the case may be, on a date appointed by him which shall not be later than thirty days from the date on which the notice under Rule 2 was delivered to him. He submits that in this case, the said notice was issued on 29-12-2021 and as per which, the entire exercise has to be completed as per the said Rule by 2B-O1-2O22, whereas as per the proceedings dated 18-01-2022, the meeting is scheduled to be held on 07 -O2-2O22, which is beyond 30 days.
