Heard the^{'learned counsel for the petitioner andthe} learned^{Government Pleader for Revenuefor the respondents'} WiththeirConsent,theWritPetitionisdisposedofattheStage of admission.

The main^{grievanceof the petitioner is that respondent} No.2 is refusing^{to receive'register andrelease the document} presented by^{them in respect of the subject property situatedat} Lalgadi^{Malakpet village, Shamirpetmandal' Medchal-Malkajgiri} district.

Learned^{Government Pleader has stated that the official} respondents^{will followthe procedurecontemplated under} Section^{71 of the Registration Act' 1908'}

4.SectionTloftheRegistrationAct,lg08,readsaSfollows:

"Reasons^{for refusalto register to be recorded'-}

[1)^{Every Sub-Registrar refusing toregistera} document,^{except on the groundthat the property} to which it^{relatesis not situatedwithinhis sub-} district^{shall make an order of refusaland} recorded^{his reasons for such order in his Book} No.2,^and endorse^the words "registratton relUSCO^oll the document: and, on^aPPlication made^{bv anv person executingor claimingunder} the^{document,shall, without paymentand}

unnecessarJ, delay, give him a copy of the reasons so recorded.

(2) No registering officer shall accept for registration a document so endorsed unless and until, under the provisions hereinafter contained, the document is directed to be registered.

In view of the above submission made b,v the learned Government Pleader coupled u,.ith the provision of Section 71 of the Registration Act, 19O8, the Writ perition is disposed of directing the Registering Authorit-r, to receive and process the subject document/s, sub.;ecr ro the petirioncrs compl-ying with the provisions of the Registration Act, l9Og, and Indian Stamp Act, 1899. It will be open to the Registering Authority to refuse/receive the document presented before him, if he has any other objection, by duly assigning reasons in support of such decision and communicate the said decision to the petitioners.
