Even though the learned GovernmentPleader has argued that the petitioners are not entitled tothe benefitof the Larger Benchjudgment as they have not filed anyapplication for enhancement of the compensationwithinthe periodprescribed in the Statute, aperusal ofthe record shows that the petitioners have been agitating for enhancementof the compensationright lrom O 1.03.20 i 1 based on the order dated01.03'2006, passed by the Principal District Judge,Nalgonda,in O.P'No.991 of 2000 and also thejudgment of this Courtpassed in L.A.A.S'No.1030 of 2OO7, dated 12.08.2008 where thecompensationwhich was fixed by the L.A.O. at Rs.31,500 f - per acrewas enhanced to Rs.47 ,25O I - per acre by the Reference Courtand finally enhanced to Rs.1,10,00O l-per acre by this Court uide judgment, dated 12.08.2008passed in Land AcquisitionFirst Appeal No.1030 of 2OO7. Admittedly, the SLP filed bythe government questioning the enhancement of compensation by theHigh Court fixing the compens ation @ Rs.1,10,000/-per acrehas been dismissed vide order, dated 15.05.2009 inC.A.No.6519 of 2009. Thereafter, it is stated in the counter thatthe enhanced amounts have been deposited on 28.06.2011 .Therefore,it cannot be said that the appiication of thepetitionersseeking compensation on par with thepatta-holders is hitby laches.
