Petition under Article 226 of lhe Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be^pleased to issue a writ, order or direction more in the nature of Mandamus declaring the action of the respondents in not completing the verification / stamping of the Petrol Pump operated by the Petitioner firm for the last one month and thereby not^granting renewal of the permission within the stipulated period there by causing severe hardship not only to the petitioner but also to the travellers travelling through N.H.¹⁶⁷ is as illegal, improper and unjust and consequently hold that the^petitioner is entitled to grant temporary permission to run the operations of the Petrol Pump of the petitioner till the completion of verification / stamping of the Petrol Pump and issue of renewal for the year 2021 with all consequential and attendant benefits.

Heard learned counsel for the petitioner and learned Government Pleader

The case of the petitioner is that he is the existing retail outlet dealer of Essar and doing business relating to sale of petrol/diesel. According to the rules, the 1st respondent has to conduct verification/ stamping of the petrol pump every year. The respondents did not complete the verification/ stamping of the petrol pump operated by the petitioner firm and thereby not granted renewal within the stipulated period. Therefore, the petitioner filed representation on 31,12.2O2O ',vith necessary fee for conducting verification/ stamping of petrol/ diesel pump before the 1sl respondent. Though the same u'as received bv the l"t respondent on O4.01.2021, no action was taken thereon. Hence, this writ petition.

Having regard to the facts and circumstances of the case, the writ petition 1S disposed of directing the 1"t respondent to dispose of the representation dated 31.12.2O2O submitted by the petitioner within one week from the date of receipt of a copy of this order and pass appropriate orders
