The publicationwas carried-outin} the A.P. Gazette extraordinary,^{Hyderabad No.02,dt.07/0112014.This notification} was issued under section-4(1)^{was published under GazetteNo.2,dated}

0710112014. Thereafter, the notice under Section - 9(1) (10) and 9 (10) of the Act were served. These provisions relate to the 1894 Act and not with reference to 20'1 3 Act. lt is submitted that the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 came into force on 0110112014 and the publication of the Gazette was made on 0710112014. ln fact, it was sent for publication by the Collector on 0710112014. Thus, the publication itself was carried-out and the Notification is deemed to have been issued after coming into force of the new Act, as such, the Notification issued under the^'1 Bg4 Act is void. Further proceedings were also conducted in terms of LA..Act,1B94.

'18-8. lt is submitted that in the light of the above submissions, the Respondents are required to issue fresh Notification in terms of the provisions of the right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 201 3.

The petitioners in ail these Writ petitions are claiming interest in the property which has been acquired by the respondents. Sincc there was dispute with regard to the sharing of the compensation payable by the respondents for acquiring the property between the petitioner and respondent Nos.S to 7, the official respondents have made a reference to the appropriate authodty. The official respondents do not dispute the total compensation payable for the acquisition undertaken. Thus, the ollicial respondents have no say rvith regard to the compensation payable.
