ORDER:
Sri B. Narasimha Sarma, learned Senior Counsel, representing Sri Parsa Ananth Nageswar Rao, learned counsel for the petitioner submits that as per the provisions of Order-43, Rule1 (r) of the Civil Procedure Code, the petitioner would be required to prefer an appeal against the order in I.A. No. 2158 of 2O2O in O.S. No. 832 of 2O2Odt. I3.O7.2O2).. He therefore seeks permission of this Court to withdraw the present revision petition with a liberty to avail remedies under the Civil Procedure Code.
Granting liberty as sought for, the Civil Revision Petition is dismissed as withdrawn. It is open for the petitioner to approach the Competent Court by filing an appeal. If such an appeal is filed, the concerned court may consider the same by condoning the delay excluding the period of pendency of the revision petition before this court.
However, there shall be no order as to costs. Miscellaneous
petitions, if any, pending in the revision, shall stand closed.
