The Criminal Petition, under Section 438 of the Code of CriminaI Procedure, 1973, is fited by the^{petitioner/accused} seeking to grant anticipatory bait in the event of his arrestⁱⁿ connection with Crime No. 56 of 7021 of Bhadrachalam^Town Potice Station, Bhadradri Kothagudem District, wl''ich was registered for the offence punishabte under Section 420 of l.P.C.

Heard the [earned counset appearing for the petitioner, learned Assistant Pubtic Prosecutor appearing for the respondent-State and perused the record.

Learned counse[ for the petitioner woutd submit that the petitioner is innocent and he has nothing to do with the atteged offence. He further submits that there is a civil suit^pending before the competent civil Court on the same subject Droperty. He atso submits that the petitioner filed a suit for partition vide O.S.No.20 of 2015, which is pending trial and in the said suit the de facto complainant fited a petition seeking amendment of written statement, wherein he wanted to make his counter ctaim. The said petition was dismissed and after dismissal of the said petition, the de focto comptainant todged the present comptaint in order to settte the scores in the said civit titigation with att fatse atlegations. He also submits that the petitioner is ready to abide by any condition that may be imposed in the event of his entargement on anticipatory bait.

As seen from the contents of the First lnformation Report and atso the fact that the 1.A.No.726 of 7019 by the de facto complainant to amend his written statement that he wanted to make his counter ctaim was dismissed and O.S.No.20 of 2015, is pending on the file of the V Additionat District Judge, Kothagudem, the dispute appears to be civit in nature. Thus, look'ing into the nature of a[tegations tevetted against the petitioner and having regard to the other facts and circumstances of the case, without detving into the merits of the case, I am inclined to grant anticipatory bait to the^petitioner.

Accordingly, the Criminat Petition is at[owed and the petitioner is granted anticipatory bait subject to the fottowing terms and conditions:

(1) The petitioner is directed to surrender before the Station House Officer, Bhadrachalam Town Potice station, Bhadradri Kothagudem District, within a^period of fifteen days from the date of this order and on such surrender, the said Station House Officer sha[[ release him on bait on his executing a^personal bond to the tune of Rs.15,000/'^(Rupees fifteen thousand onty) with two sureties to the tike amount each to his satisfaction.

(2) The petitioner shatt abide by the other conditions stiputated in Section 438(2) Cr.P.C and co-operate with the^{lnvestigating} Officer in investigating the case.
