Heard learned counsel for the parties.

Learned Additional Advocate General, on instructions, submits that the 1^st respondent in Writ Petition (PIL) No. 43 of 2016 shall take steps to appoint Vice Chancellor of the respondent – University and shall complete the process before the end of June, 2016.

In view of the statement made by learned Additional Advocate General, learned counsel for the petitioners state that the petitions may be disposed of directing the 1^st respondent to appoint Vice Chancellor by following the due procedure and appoint a person who is competent to hold the post of Vice Chancellor.

In view of the submissions of learned counsel for the parties, we are satisfied that the following order shall meet the ends of justice:

“Respondent No.1 shall take steps to make an appointment of Vice Chancellor of the respondent – University and complete the process of appointment on or before 30-06-2016. It is needless to mention that the 1^st respondent shall follow the due procedure contemplated by law and that they shall appoint the person who is competent to hold the post of Vice Chancellor. It is further made clear that once the process of selection and appointment of Vice Chancellor is complete and the appointment order is issued, the

In-charge Vice Chancellor shall cease to be the Vice Chancellor without further reference to the Court and shall handover the charge to the newly appointed Vice Chancellor. If that it not done, it would be open to the newly appointed Vice Chancellor to take charge unilaterally. This however shall not preclude either the In-charge Vice Chancellor or any other person to challenge the appointment of Vice Chancellor, if he/she desires or advised, before the appropriate forum, on all the grounds that may be available in law.”

With these observations, the writ petitions are disposed of. Miscellaneous petitions, if any, also stand disposed of.
