In this public interest litigation (PIL), the petitioner seeks direction to the official respondents to remove the alleged encroachments on the land of Podalakur Panchayat Bus Stand, and public road, as stated in the prayer clause. It is alleged that respondent Nos.12 to 32 and several others have committed encroachment on the land belonging to bus stand and public road.

In view of the allegations made in the writ petition, on last occasion, we had directed unofficial respondents to file affidavits/undertakings before this Court stating that they have not made any encroachments upon any public road or bus stand and if any encroachment is noticed or found, they have no objection for removal of the same. Except respondent Nos.14, 19, 29 and 31, all other respondents have filed affidavits/undertakings. We have perused the affidavits/undertakings. The statements made therein are

accepted.

In the circumstances, we direct respondent – District Collector to once again verify whether there is any encroachment, as alleged and if it is found that there is an encroachment, he may proceed to take action against all encroachers including the unofficial respondents in the instant PIL in accordance with law. It is needless to mention that the Collector shall complete the exercise within six months from today. With these observations, the PIL is disposed of. Miscellaneous petitions, if any, also stand disposed of.
