Heard learned counsel for the parties.
At the outset, Mr. S. Ravi, learned Senior Counsel appearing for respondent No.1, invited our attention to Section 16 of the National Green Tribunal Act, 2010 (for short ‘the Act’), and submitted that the order dated 6.3.2014, issued by the Ministry of Environment and Forests, impugned in the present P.I.L., is appealable.
Having confronted with this, learned counsel for the petitioner does not press this P.I.L. and seeks liberty to the petitioner to challenge the impugned order, on all grounds that are raised in the instant P.I.L., in appeal, under Section 16 of the Act.
The Public Interest Litigation is disposed of as not pressed with liberty as prayed. It is open to the petitioner to file an application for condonation of delay in filing the appeal and if any such application is filed, we hope and trust that the National Green Tribunal shall consider the same in proper perspective and shall hear the appeal on merits, in accordance with law.
Consequently, pending miscellaneous applications shall also stand closed.
