This Writ Petition is filed challenging the order dated 17.2.2014 in Original Application No.584 of 2014 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad (for short, ‘the Tribunal’).

By virtue of the impugned order, the official respondents were directed to complete the process of finalization of seniority list of Prohibition and Excise Inspectors, Assistant Prohibition and Excise Superintendents duly following the orders of the Tribunal in Original Application No.11590 of 2009 and batch dated 17.03.2010 and the final orders of this Court in Writ Petition No.3052 of 2010 and batch, within a period of four months from the date of receipt of a copy of the said order.

When a challenge was made to the order of the Tribunal dated 17.03.2010 in Original Application No.1111 of 2010, this Court passed an interim order dated 31.10.2012 in W.P.M.P.Nos.37881 of 2012 in W.P. No.13052 of 2010 and batch, permitting the official respondents to effect promotions taking into consideration the seniority list dated 29.9.2009, and it is made clear by the Tribunal that promotions already effected on adhoc basis pursuant to the orders of the Tribunal, if any, might not be disturbed/reversed. However, Writ Petition No.13052 of 2010 and batch were dismissed by this Court by an order dated 24.01.2014. Miscellaneous Petitions

filed in the said Writ Petitions were also disposed of. The Tribunal order dated 17.03.2010 in Original Application No.1111 of 2010 was confirmed. Therefore, the provisional seniority list basing on which tentative list dated 14.12.2012 was published in the Gazette on 19.12.2012, is also liable to be set aside. This aspect of the case has not been considered by the Tribunal. The impugned order is, accordingly, set aside and the matter is remanded to the Tribunal with a request to dispose of the Original Application on merits after giving opportunity to both sides.

5. The Writ Petition is, accordingly, allowed remanding the matter to the Tribunal. No costs. Miscellaneous Petitions pending, if any, in the Writ Petition shall stand closed.
