While the petitioner/applicant was working as Head Constable at Kandaleru Police Station of Nellore District, a news item was published in Eenadu News Paper on 17.10.1999 under the caption that the police constables in the station, under the influence of liquor, assaulted each other. Basing on the above news item, a preliminary enquiry was conducted and a departmental enquiry was initiated by respondent No.3. Thereafter, a charge memo was served upon the applicant alone leaving the other constables. The applicant submitted his reply denying the charges and requested to entrust the enquiry to some other officer, but of no avail. Then, the applicant filed O.A.No.5441 of 2000 before the Tribunal, and the Tribunal, vide order, dated 7.9.2000, directed the respondents to examine the representation of the applicant for change of Enquiry Officer and to pass appropriate orders within a period of one week from the date of receipt of a copy of that order. Accordingly, respondent No.2 issued proceedings, dated 5.1.2001, stating that there is no provision to change the Enquiry Officer from Nellore District to another unit. Thereafter, the Enquiry Officer conducted ex parte enquiry and submitted his report holding that the charges are proved.
