2. Petitioner, who is a student, applied for the post of Police Constable in Kurnool District. He made a claim on the basis of Scheduled Caste Certificate issued to him on 23.08.2008 by the Tahsildar, Nandyal, that he belongs to S.C.Mala Community. He states that as per the proceedings of the Collector and the District Magistrate in Rc.No.C6/524/M/2013 dated 11.03.2014, his Caste Certificate was cancelled after enquiry. Aggrieved thereby, the petitioner has preferred an appeal before the first respondent on 02.04.2014 along with an interim application for stay of operation of the order of the Collector. The grievance of the petitioner is that neither the said appeal nor the stay petition is taken up though four months have been elapsed. Petitioner states that the first respondent has already called for records from the Collector vide Memo No.4914 /CV.1/2014 dated 02.05.2014, to examine the said appeal and the stay petition. He further states that on account of cancellation of the Caste Certificate, he is suffering prejudice and it is imperative on the part of the first respondent to take up and decide at least, stay petition filed along with the appeal.
