This writ petition is filed by the petitioners questioning the Memo No.B/11008/2003 dated 23.09.2003 issued by the 1^st respondent directing the Village Administrative Officer, Old Bowenpally Village to incorporate the name of the 2^nd respondent as possessor of Ac.7.00 of land in Sy.No.47 of Old Bownepally Village, Balanagar Mandal, Ranga Reddy District, as arbitrary and without jurisdiction.

2. The impugned memo reads as under:

The Village Administration Officer, Old Bowenpally village is informed that the land in Sy.No.47 admeasuring Ac.8-31 cents situated at Old Bownepally village has inspected on 20-9-2003 and on the spot it is seen that an extent of 1-31 acres is covered by Houses and the remaining extent is under the enjoyment and possession of Sri C. Venkat Reddy, S/o. late Penta Reddy and they are drawing mud by digging pits.

Therefore, the V.A.O, Old Bownepally village is hereby directed to enter the name of Sri C. Venkat Reddy, S/o. late Penta Reddy in possession column in respect of Sy.No.47 to an extent of Ac.7.00 situated at Old Bowenpally village in Revenue Records for the year 2003-2004 and report compliance.

The learned Government Pleader would submit that the action of the respondents in issuing the memo of the above said nature is being outside the scope of the provisions of the R.O.R Act and the same is liable to be set aside. In support of his submission, he placed reliance on the judgment of this Court passed in W.P.No.24775 of 2002 (Kallem Penta Reddy and Mandal Revenue Officer, Saroornagar Mandal, Ranga Reddy District and others), wherein this Court had held that under the scheme of R.O.R Act, there is no provision and power to the Mandal Revenue Officer to issue the memo of this nature.

4. Recording the said submission, the writ petition is allowed setting aside the Memo No.B/11008/2003 dated 23.09.2003 issued by the 1^st respondent. No order as to costs. Miscellaneous Petitions, if any, pending in this writ petition, shall stand closed.
