WRIT PETITION No. 11321 of 2008
ORDER:
Heard learned counsel for the petitioner and learned Standing Counsel for the respondents 1 and 2.
2. The petitioner submits that the grandmother of the petitioner was the absolute owner and possessor of the House bearing Municipal No.19-2-21/1, along with open land, admeasuring 373 sq.yds., situated at Misri Gunj, Kalapather, Hyderabad. During the lifetime of the grandmother, she executed a registered gift deed in favour of the petitioner gifting the property to an extent of 300 sq. yds vide Doct.No.76/99 dt. 04.02.1999. When some third parties tried to interfere with the possession with the assistance of Municipal Corporation of Hyderabad, the petitioner’s grandmother filed W.P.12430 of 1998 and the same was disposed of on 30.04.1998 directing the Municipal Corporation authorities not to interfere with the possession and enjoyment of the petitioners without following due process of law. When another attempt was made on 24.03.2008, the present writ petition was filed.
3. This Court, by order dated 28.05.2008, granted interim direction to the respondents not to dismantle or remove the walls along with rooms belonging to the petitioner in H.No.19-2-21/1 admeasuring 300 sq.yds.,
situated at Misri Gunj, Kalapather, Amjadowlahbagh, Opp. To Galebjung Makhbara, Hyderabad.
4. Learned counsel for the petitioner submits that there is no interference thereafter and in view of the same, the interim direction passed on 28.05.2008 can be made as final order and the writ petition can be closed.
5. Recording the said submission, the writ petition is closed. There shall be no order as to costs.
6. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
