This appeal, under Section 54 of the Land Acquisition Act, 1894, is filed by the Special Deputy Collector (Land Acquisition) aggrieved by the order, dated 31.07.2004, passed in L.A.O.P.No.51 of 2001 by the learned Senior Civil Judge, Allagadda, by which, the reference Court has fixed the market value at Rs.64,000/per acre for the lands in question.
It is submitted that the subject matter of this appeal is squarely covered by a common judgment rendered by a Division Bench of this Court in L.A.A.S.No.981 of 2005 and batch, dated 21.06.2007, and a copy of the said judgment is placed on record.
A perusal of the judgment, dated 21.06.2007, discloses that against the common order, dated 31.07.2004, passed in some of the O.Ps., the State has filed the aforesaid batch of cases and this Court by judgment, dated 21.06.2007, dismissed the batch of cases confirming the market value fixed by the reference Court.
Therefore, as the subject matter of this appeal is squarely covered by the earlier judgment, dated 21.06.2007, this appeal is also dismissed following the aforesaid judgment and for the reasons recorded therein.
Miscellaneous Petitions, if any, pending shall stand closed. No costs.
