This petition is filed to quash D.V.C.No.19 of 2012 on the file of Judicial First Class Magistrate at Manthani.
Heard both sides.
The main contention of learned counsel for petitioners is that petitioners are no way concerned with the disputes between the complainant and her husband. He further contended that the petitioners are falsely implicated to harass them.
I have perused the material papers filed along with quash petition.
In the complaint, there are allegations against the petitioners also, therefore, I feel that this Criminal Petition can be disposed of directing the court below to dispose of main D.V.C. within a stipulated time by dispensing with the presence of these petitioners.
For these reasons, this Criminal Petition is disposed of directing the court below to dispose of the D.V.C.No.19 of 2012 as expeditiously as possible preferably within four months from the date of receipt of
copy of this order by dispensing with the presence of the petitioners for each and every adjournment. However, petitioners shall appear before the trial court as and when directed if it feels that their physical presence is necessary for any specific purpose. Petitioners are at liberty to urge these grounds before trial court and the trial court shall consider the same without being influenced by the disposal of this petition.
As a sequel to the disposal of this Criminal petition, the Miscellaneous Petitions, if any, pending, shall stand dismissed.
