This Criminal Petition is filed to quash FIR in Crime No. 52 of 2012 of Kothapatnam Police Station, Prakasam district, for alleged offences under section 171-E, 188 of IPC and section 34 (a) of A.P. Excise Act, 1968.

2. Heard both sides.

¶18

3. Learned Public Prosecutor submitted that Police have not proceeded with investigation, as they were under the impression that all further proceedings are stayed.

4. I have perused the material papers filed along with this criminal petition. As seen from the proceedings sheet, stay is only for arrest of the petitioner and there is no stay for investigation.

5. Considering the facts and circumstances of the case and submissions of both sides, without going into merits, I feel that this criminal petition can be disposed of directing police to proceed with investigation by continuing interim order with regard to arrest of the petitioner.

6. Accordingly, this Criminal Petition is disposed of directing police to complete investigation and file final report as expeditiously as possible and in the meantime not to arrest the petitioner till completion

of investigation.
