CRIMINAL PETITION NO.3485 OF 2012
ORDER:
The petitioners-respondent Nos.1 to 5 filed this Criminal Petition under Section 482 Cr.P.C. seeking to quash the proceedings in D.V.C.No.4 of 2011 on the file of the Judicial First Class Magistrate at Banswada, Nizamabad District.
Heard both sides.
In view of the earlier proceedings between the parties and on consideration of submissions of both sides, I feel instead of deciding the merits of the case, lower Court be directed to dispose of the case within a stipulated time by dispensing with the presence of petitioner Nos.2 to 5 during enquiry of D.V.C.No.4 of 2011.
Accordingly, the Criminal Petition is disposed of directing the Court below to decide the matter on merits within three (3) months from the date of receipt of a copy of this order, by considering the earlier criminal proceedings and by dispensing with the presence of petitioner Nos.2 to 5 at the time of enquiry. Miscellaneous petitions, if any, pending shall stand closed.
