O R D E R :
This Criminal Petition is filed under section 482 Cr.P.C. to quash F.I.R. in Crime No. 26 of 2012 of II-Town Police Station, Mahboobnagar district, registered for offences punishable under section 420 and 409 of IPC.
2. When the matter is listed on 04/04/2014 proof of service is not filed and none appeared for petitioner and the matter is directed to be listed on 25/04/2014 “for dismissal”. Today, none appeared for petitioner inspite of posting the matter under the caption of dismissal. As seen from the record, after obtaining stay no interest is evinced in prosecuting the case. Since investigation of FIR in Crime No.26 of 2012 is stalled on account of this criminal petition, I feel that this criminal petition is liable to be dismissed for non-prosecution.
3. Accordingly, this Criminal Petition is dismissed for nonprosecution.
