JUDGMENT:
This appeal is filed by the appellant to set aside the Judgment and Decree dated 03.06.2010, passed by the Chief Judge, City Civil Court, Hyderabad in OS.No.393 of 2006.
During the pendency of the appeal, the appellant and the respondents have filed Memorandum of Compromise, which is signed by the parties and their counsel. The said compromise is accompanied by a petition i.e. CCCA.MP.No.433 of 2014, seeking to dispose of the Appeal by decreeing the suit in terms of compromise entered into between the parties.
Heard learned counsel for the appellant as well as learned counsel for the 1st and 2nd respondents.
The appellant and respondents 1 and 2 are present in person and they are identified by their respective counsel. The parties, who are present in the Court, admit the terms of Compromise.
Both the learned counsel submit that part of the property which fell to the share of 1st respondent was settled in favour of appellant towards full and final settlement and accordingly they entered into the compromise.
In view of the above, the Compromise entered into between the parties is hereby recorded and CCCA MP.No.433 of 2014 is ordered. A decree be drawn in accordance with the terms of
Compromise and a copy of the Memorandum of Compromise shall form part of the record. Accordingly, the appeal is disposed of in terms of Compromise entered into between the parties. No costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the appeal, shall stand closed.
