K.v.Ram Babu, Vs Mr. I.Y.R. Krishna Rao

Sri Ch.Krishnaiah, who claims to have worked as Tahsildar, Chityal Mandal, Nalgonda District, till 10.02.2014, filed a counter-affidavit, in which, he has stated that as the order of this Court was not brought to his notice till 10.02.2014, he could not pass the order. While assuring that this mistake will not be repeated in future, he has stated that the order of this Court has been complied with by the present incumbent by passing order, dated 17.02.2014. A copy of the said order is enclosed to the counter-affidavit.

Sri Venkat Reddy Donthi Reddy, learned counsel for the petitioner has stated that a copy of the order furnished to his client has been passed on 16.02.2014 but not on 17.02.2014.

A perusal of the copy of the order filed along with the counteraffidavit shows that it bears the date of 16.02.2014 and that it has been corrected with pen as 17.02.2014. This Court is not inclined to delve into this minor discrepancy as the fact remains that an order as directed by this Court has been passed albeit with delay, which has been explained in the counter-affidavit.

In the light of the above facts, the Contempt Case is closed, however, with liberty to the petitioner to avail appropriate remedy if he feels aggrieved by order, dated 17.02.2014.
