Guguloth Chinna Venkulu Vs The Special Deputy Collector, (Land Acquisition)

Notice vide proceedings bearing No.C/11/2008, dated 27.09.2012, issued by respondent No.1 purportedly under the Revenue Recovery Act is questioned in this writ petition.

The main ground on which the writ petition is filed is that the said proceedings under which respondent No.1 has called upon the petitioner to pay Rs.1,37,838/- purportedly representing the excess compensation received by the petitioner is not preceded by prior notice.

On 28.12.2012, at the request of the learned Assistant Government Pleader for Land Acquisition, the case was adjourned. Today, the learned Government Pleader for Land Acquisition stated that since the impugned notice does not appear to have been preceded by a show-cause notice, the same may be directed to be treated as a show-cause notice.

In view of this fair submission, the impugned proceedings shall be treated as show-cause notice and the petitioner shall file his objections before respondent No.1 within a period of 15 days from the date of receipt of a copy of this order. Thereafter, respondent No.1 shall consider the objections, if any filed by the petitioner and pass a speaking order.

Subject to the above direction, the writ petition is disposed of.

As a sequel to disposal of the writ petition, W.P.M.P.No.50891 of 2012 shall stand disposed of as infructuous.
