The Court made the following:
ORDER:
The action of the respondents in not paying compensation in stead of ex gratia in respect of the lands admeasuring Ac.0.80 cents in Survey No.135/2 and Ac.0.99 cents in Survey No.135/3 of Gandrajupalli Village fields, Gangavaram Mandal, Chittoor District is questioned in this writ petition.
Respondent No.3 filed a counter affidavit.
The learned Government Pleader for Land Acquisition fairly submitted that initially on the petitioner’s own request, ex gratia was paid, and that later it came to light that the above-mentioned lands are private lands belonging to the petitioner and that he is entitled to payment of compensation, instead of ex gratia. He submitted that respondent Nos.1 to 3 will compute differential amount between the compensation and ex gratia and pay the same to the petitioner within a period of three months.
The above submission of the learned Government Pleader is placed on record and the writ petition is accordingly disposed of.
As a sequel to disposal of the writ petition, W.P.M.P.No.50234 of 2012 shall stand disposed of as infructuous.
