The Court made the following: ORDER:
This Writ Petition is filed for a mandamus to declare the action of respondent No.3, in not registering the sale deeds in respect of Ac.1.59 cents of land in Survey No.48/1 and Acs.8.41 cents of land in Survey No.59 of Pothina Mallayyapalem Village, Visakhapatnam District, as illegal and arbitrary.
After arguing the case, Sri K. Jyothi Prasad, learned Counsel representing the petitioner, requested for permission of the Court to withdraw the Writ Petition, with liberty to his client to file a fresh Writ Petition with proper relief in order to challenge the validity of G.O.Ms.No.585 Revenue (Registration1) dated 04-05-2005.
The request of the learned Counsel for the
petitioner is accepted and the Writ Petition is, accordingly, dismissed as withdrawn, with liberty to the petitioner in terms of the prayer made.
As a sequel to dismissal of the Writ Petition, W.P.M.P.No.4936 of 2013, filed by the petitioner for interim relief, is disposed of as infructuous.
