ORDER:

This Writ Petition is filed for the following substantive relief.

“…to declare the action of the respondents in not handing over the possession of the house sites admeasuring 60 square yards each, covered by survey No.579, New Shayampet Village, Hanamkonda Mandal, Warangal District, though the patta was granted in favour of the petitioners on 24.04.1998, as illegal, arbitrary and consequently to direct the respondents to deliver possession in respect of house sites admeasuring 60 square yards each in survey No.579 situated at New Shayampet Village, Hanamkonda Mandal, Warangal District, to the petitioners.”

It is indeed incredulous that the petitioners, in whose favour the house site pattas were granted as far back as 24.04.1998, have not been handed over physical possession of the house sites.

Learned Assistant Government Pleader for Revenue (Assignments), on instructions confirming the claim of the petitioners that they were not granted house site pattas, submitted that respondent No.2 will very shortly hand over physical possession of the same to the petitioners.

In view of the above submissions of the learned Assistant Government Pleader for Revenue (Assignments), respondent No.2 is directed to hand over physical possession of the house sites to the petitioners within one (1) week from the date of receipt of this order.

Subject to the above direction, the Writ Petition stands disposed of.

As a sequel to disposal of the Writ Petition, WP.MP.No.48052 of 2013 filed by the petitioners for interim relief shall stand disposed of as infructuous.
