Feeling frustrated by the enormous delay in denotifying Ac.591-00 of land in Sy.Nos.32 to 38, 40, 42 to 47, 70, 72 to 74 and 76 to 87 of Sikindlapur village, Shivampet Mandal, Medak District, as ‘Dastagardha Inam’ lands, the petitioners have filed this Writ Petition.

A perusal of the record shows that as far back as 1411-2004, respondent No.4 has submitted a report to respondent No.2 wherein he has informed that as per the revenue records, the subject lands are classified as ‘Inam Dastagirdha’ lands and that they do not show the lands as ‘service inam’ or ‘mafi inam’ attached to any religious institution. He further submitted that about 100 families of the village are eking out their livelihood depending upon cultivation of the lands and that if the lands are treated as Wakf lands, the interests of the inamdars as well as the purchasers, including the villagers who are cultivating the lands for a long time, will be adversely affected. He has accordingly requested the Government to denotify the lands as Wakf lands. Following the said report, respondent No.3

has submitted his report vide CCLA’s letter No.NA1/76/05, dated 15-4-2005 to respondent No.2 reiterating the request of respondent No.4. The grievance of the petitioners is that so far no further action has been taken for denotification of the lands.

The learned Assistant Government Pleader for Revenue (Telangana Area), on instructions, submitted that respondent No.1 has called for a report from respondent No.4 which is expected to be sent by the latter within one week and that immediately thereafter appropriate steps will be taken.

In my opinion, the enormous delay of about nine years in taking action on the reports of respondent Nos.3 and 4 cannot be justified. However, in view of the above noted submission of the learned Assistant Government Pleader, the Writ Petition is disposed of with the direction to respondent No.2 to do the needful in the light of the above mentioned reports of respondent Nos.3 and 4 as expeditiously as possible and not later than two months from the date of receipt of this order.

The Writ Petition is accordingly disposed of.

As a sequel to the disposal of the Writ Petition, WPMP Nos.45943 and 45944 of 2012, filed for interim reliefs are disposed of as infructuous.
