Respondent No.5, who is no other than the sisterin-law of the petitioner, was granted a house site patta as far back as the year 2006 by respondent No.3. The petitioner pleaded that the property for which the house site patta was granted to respondent No.5 is a private property belonging to the family of the petitioner and the husband of respondent No.5 and that while the latter had only half share in the said property, respondent No.3 granted assignment to respondent No.5 in respect of the whole property including the share of the petitioner by treating the same as the Government property.

In my opinion, the appropriate remedy for the petitioner is either to file a civil suit for a declaratory relief or an appeal under the Board Standing Orders at his

option to the effect that the property in respect of which respondent No.5 was granted house site patta is his family property.

In this view of the matter, without expressing any opinion on the claim of the petitioner, the Writ Petition is disposed of with liberty to the petitioner to avail the above-mentioned remedies at his option.

As a sequel to disposal of the Writ Petition, W.P.M.P.No.46867 of 2013 filed by the petitioner for interim relief is disposed of as infructuous.
