The land to an extent of Acs.380.33 ½ guntas in various survey numbers of Pothgal Village, Karimnagar Mandal belongs to the petitioners and others was acquired for the purpose of construction of Lower Manair Dam, Karimnagar District and an award was passed on 21.03.1991 fixing compensation at Rs.510/- per acre for dry land, Rs.660/- per acre for black cotton soil land, Rs.1,670/- per acre for single crop wet land and Rs.3,180/- per acre for double

crop wet land. Not satisfied with the compensation determined, the petitioners along with others sought for reference under Section 18 of the Land Acquisition Act, 1894 and on such reference in O.P.No.440 of 1985, the Senior Civil Judge, Karimnagar enhanced the compensation. Aggrieved by the same, the Land Acquisition Officer-3^rd respondent preferred A.S.No.3175 of 1987 before this Court, wherein the petitioners and others also filed cross objections. This Court while dismissing the appeal, allowed the cross objections and enhanced the compensation, by judgment dated 01.12.1992. The said order has become final.

The petitioners and other claimants filed E.P.No.34 of 1997 before the Sub-Judge at Karimnagar. Partial amount of compensation was paid during the pendency of the Execution Petition. Since assurance was given that the balance amount will also be paid, E.P. was closed on 19.04.1999. Aggrieved thereby, the petitioners filed E.P.No.24 of 2001. However, so far, the amount is not paid. Though the E.P. is pending, the requisition department has not deposited the amount for settlement of compensation.

On instructions, the learned Government Pleader submits that the balance amount of compensation could not be paid since the requisition department has not deposited the amount and therefore, requests some more time for settlement of compensation due and payable to the petitioners.

Having regard to the facts of the case, it is highly deprecated that even though the land was acquired as early as in the year 1991, so far compensation due and payable to the petitioners has not been paid.

Having regard to the request made by the learned Government Pleader, this Writ Petition is disposed of directing the 1^st respondent to deposit the amount payable to the petitioners within a period of two (2) months from the date of receipt of a copy of this order. There shall be no order as to costs.

Miscellaneous petition, if any, pending in this writ petition, shall stand closed.
