The Court made the following: ORDER:
This Writ Petition is filed for a Mandamus to declare the action of the respondents in interfering with the petitioner’s possession and enjoyment of land admeasuring Acs.2.00 in Survey No.41 of Yellava Palli Village, Porumamilla Mandal, Y.S.R.Kadapa District, as illegal and arbitrary.
After arguing the case, Sri N.Parameswara Reddy, the learned counsel for the petitioner, requested for permission of the Court to withdraw the Writ Petition with liberty to his client to file a civil suit for injunction to restrain respondent No.4 from interfering with his possession of the property covered by the DKT patta.
Subject to the liberty given to the petitioner as above, the Writ Petition is dismissed as withdrawn.
As a sequel to dismissal of the Writ Petition, W.P.M.P.No.37110 of 2013 is dismissed as infructuous.
