The Court made the following: ORDER:
This Writ Petition is filed for the following substantive
relief:
“……….issue a writ, order or direction more particularly one in the nature of Writ of Mandamus questioning the action of respondent No.4 in not handing over the land as per the orders of respondent No.2, vide proceedings Rc.B.463/2012 dated 24.06.2013 though the petitioner made representation dated 23.07.2013 as illegal, arbitrary violative of Articles 14, 16 and 300 A of the Constitution of India and consequently, to direct respondent No.4 to restore the possession of the petitioner in respect of the land to an extent of Acs.3.52 cents in Survey No.65 of Pittavanipalli Village, Chittamur Mandal, SPSR Nellore District.”
At the hearing, Sri M.K.Raj Kumar, the learned counsel for the petitioner, after realising that the Writ Petition is pre-mature, requested for permission to withdraw the Writ Petition with liberty to his client to avail
a fresh remedy at an appropriate stage in future. The Writ Petition is, accordingly, dismissed as withdrawn with liberty to the petitioner in terms of the prayer made.
As a sequel to the dismissal the Writ Petition, W.P.M.P.No.32223 of 2013 is dismissed as infructuous.
