The Court made the following: ORDER:

This Writ Petition is filed with the grievance that the respondent has not been issuing a fresh passport with correct date of birth to the petitioner.

At the hearing, Sri Venkata Rangadas Kanuri, the learned counsel for the petitioner, stated that when the petitioner sought to approach the office of the respondent with an application for issuance of fresh passport by correcting his date of birth as 08.03.1995, the same was not received on the ground that unless the application is accompanied by a Court order the same will not be received.

When Writ Petitions were filed earlier with a similar

grievance, the Regional Passport Officer has personally attended the Court and submitted that recently he has issued a Circular directing his office to receive every application that may be made in connection with passports and that on receipt of such applications, the same will be processed and appropriate communications will be sent to the applicants within a reasonable time.

Except the ipsi dixit of the petitioner that his application was not received by the office of the respondent, he has not produced any evidence in support thereof such as legal notice. This Court is unable to accept the petitioner’s statement in the face of the statement made by the Regional Passport Officer before this Court. Therefore, no Mandamus can be issued to the respondent at this stage. The petitioner is permitted to make an on-line application to the respondent besides sending a photo copy of the same through registered post with acknowledgment due to the office address of the respondent. Within four weeks of receipt of such application, the respondent shall take appropriate decision and communicate the same to the petitioner.

Subject to the above directions, the Writ Petition is disposed of.

As a sequel to disposal of the Writ Petition, W.P.M.P.No.31560 of 2013 filed by the petitioner for interim relief is disposed of as infructuous.
