ORDER:
This writ petition is filed for a certiorari to quash the impugned letter dated 29.07.2013 addressed by respondent No.3 to respondent No.4, whereby respondent No.3 has requested the Station House Officer, Undrajavaram Police Station to grant police protection to respondent No.5 in respect of the land admeasuring Acs.1.25 cents in R.S.No.181/5 of Undrajavaram Village, Dwaraka Tirumala Mandal, West Godavari District.
This Court, on 22.08.2013, while directing the respondents not to dispossess the petitioner from the land in question, further directed respondent No.3 to file a counter-affidavit, wherein he shall state the provision of law under which he is empowered to recommend police aid to a private party in respect of private land by today apart from directing his personal appearance. Today, respondent No.3 has filed a counter-affidavit besides being personally present in the Court. In his counter-affidavit, while describing that he has addressed the impugned letter “by inadvertence”, respondent No.3 stated that he has withdrawn the impugned letter, vide Roc No.560 of 2013 dated 30.08.2013. Respondent No.3 has also tendered unconditional apology for issuing the impugned letter.
Having regard to the above subsequent events leading to withdrawal of the impugned letter and the realization of respondent No.3 that his issuing the impugned letter is a mistake, the Writ Petition is disposed of as infructuous.
As a sequel to disposal of the Writ Petition, interim order dated 22.08.2013 is vacated and W.P.M.P.No.30265 of 2013 filed by the petitioner for interim relief shall stand disposed of as infructuous.
