This writ petition is filed by the Andhra Pradesh Non-Gazetted Officers’ Association questioning the validity of G.O.Rt.No.2442, General Administration (SW.I) Department dated 30.05.2013, whereby the Principal Secretary to Government, Social Welfare Department and the Principal Secretary to Government (Stamps & Registration) Revenue Department have been nominated as members of the committee of officers and representatives of service associations/unions to examine the request of the President, Andhra Pradesh Government Employees’ Association for according recognition to the association.

The short ground on which the petitioner filed the present writ petition is that while G.O.Ms.No.90, General Administration (SW.I) Department, dated 25.02.2005, envisaged a nine-member committee for according recognition and membership to any service association/union in the Andhra Pradesh Civil Services Joint Staff Council (State Level), the impugned G.O. has restricted the number of members of the committee only to two.

In the counter-affidavit filed by the Assistant Secretary to Government (SU.II), General Administration Department, it is inter alia stated that the impugned G.O. was issued nominating Sri Raymond Peter, I.A.S., Principal Secretary to Government, Social Welfare Department and Sri Vinod Kumar G.Agrawal, I.A.S., Principal Secretary to Government (Stamps & Registration) Revenue Department in order to fill the slots at serial numbers 3 and 4 of G.O.Ms.No.90 dated 25.02.2005 while retaining the other seven members of the committee constituted under the said G.O. for considering the application of respondent No.3.

Sri M.Surender Rao, learned counsel for the petitioner, stated that in view of the above noted clarification made by respondent No.1 in the counter-affidavit, his client can have no grievance.

In the premise as above, the Writ Petition is disposed of by placing on record the stand of respondent No.1 that the application of respondent No.3 will be considered by the nine-member committee as envisaged in G.O.Ms.No.90 dated 25.02.2005 with the two members nominated in G.O.Rt.No.2442 dated 30.05.2013 being part of the ninemember committee.

As a sequel to disposal of the writ petition, interim order dated 02.08.2013 stands vacated and W.P.M.P.No.25864 of 2013 and W.V.M.P.No.2700 of 2013 shall stand disposed of as infructuous.
