ORDER:
This Transfer C.M.P. is filed by the petitioner – Smt. Pamulaparthi Sujatha seeking transfer of O.P. No.129 of 2012 from the file of the Judge, Family Court, Ranga Reddy at L.B. Nagar, to the Court of the Senior Civil Judge, Peddapalli, Karimnagar District.
2. The petitioner is the wife of the respondent – P. Anil Kumar.
3. Notice is not served on the respondent. However, as notice was taken to the same address given by the respondent in O.P. No.129 of 2012 filed by him before the Judge, Family Court, Ranga Reddy at L.B. Nagar, it is deemed that notice has been served on him.
4. Heard the learned counsel for the petitioner and perused the material available on record.
5. The petitioner filed M.C. No.18 of 1997 before the learned Judicial Magistrate of First Class, Peddepalli, for maintenance and it was allowed by the order dated 26-05-1998.
6. The respondent filed O.P. No.122 of 1997 before the Senior Civil Judge's Court, Karimnagar, seeking divorce, however the same was dismissed by the order dated 22-04-1998. The respondent again filed O.P. No.129 of 2012 seeking divorce.
7. The case of the petitioner is that she is a woman and depending upon her parents and that she cannot meet the travelling expenses to go to Hyderabad to attend the divorce case.
8. In view of the difficulties expressed by the petitioner, O.P. No.129 of 2012 is withdrawn from the file of the Judge, Family
Court, Ranga Reddy at L.B. Nagar, and transferred the same to the Court of the Senior Civil Judge, Peddapalli, Karimnagar District.
9. Accordingly, the Transfer C.M.P. is allowed. Consequently, the Miscellaneous Petitions, if any, pending in this transfer petition shall stand closed. No costs.
